New Louisiana Governor’s Proclamation Number 59 JBE 2020 revising courts operation suspension until Friday, June 5, 2020

JEFFERSON, LA - All Louisiana Justice of the Peace Courts have been ordered to continue the suspension of their operation canceling all civil trials, hearings and court appearances until Friday, June 5, 2020 in compliance with the Louisiana Governor’s State of Emergency for COVID-19 Proclamations and Louisiana Supreme Court Orders. Further all civil legal deadlines, including prescription, are also suspended until Friday, June 5, 2020. These orders and deadlines are subject to change at any time. All parties will receive appropriate legal notice of their new court appearance dates.

Parties are currently allowed to file civil suits, eviction cases, pleadings and answers. Service may be attempted. Parties filing eviction cases before Friday, June 5, 2020 with hearings scheduled on or after Monday, June 5, 2020 may incur additional court costs if revised orders extending the court’s suspension are received.

Landlords attempting to exercise their rights to evict tenants are required to comply with the new legal constraints as mandated under the Federal CARES Act. Landlords and tenants should review the provisions of the CARES Act. Prior to filing their case Landlords must determine and acknowledge if their property is covered under the act. Properties federally subsidized as well as properties with mortgages owned or secured through a federal program prevents a landlord from evicting a tenant for non-payment of rent and fees during the period from March 27, 2020 through July 25, 2020 followed by a 30 day notice.

During this time it is not an opportunity for tenants to avoid paying rent nor give landlords a chance to repossess their property.

These orders are necessary to protect the health and safety of the public in line with the best guidance and direction from the White House, the Governor, the Centers for Disease Control, and state health officials.
